JUSTICE ARVIND SRIVASTAVA ORAL ORDER 29-08-2017 Heard learned counsels for the petitioner and the State. Petitioner seeks bail in connection with Bhupatiyahi P.S. Case No. 80 of 2016 registered for the offence punishable under sections 302, 201, 120B of the Indian Penal Code. Learned counsels appearing for the petitioner submits that petitioner is not named in the first information report. The SIM in question is not registered in the name of this petitioner. There is no eye witness to the alleged occurrence. Similarly situated co-accused has been granted bail by this Court vide order dated 20.07.2017 passed in Cr. Misc. No. 30606 of 2017. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail
