2. The petitioner makes a prayer for grant of regular bail in connection with Session Trail no.733 of 2024 arising out of Gaighat P.S.Case No. 187 of 2024 registered under section 103(1) of the BNS.

3. However, subsequently after the course of investigation, charge sheet has been submitted under section 108 read with Section 85 of the BNS and the cause of death has been found asphyxia as a result of ante mortem.

4. Learned counsel for the petitioner submits that the petitioner happens to be the husband of the deceased lady and he was married to the deceased 28 years ago and having five children from the wedlock. Earlier, there has been no complaint

Patna High Court CR. MISC. No.14168 of 2025(2) dt.19-03-2025 2/2 against the petitioner with regard to meeting out any kind of cruelty upon the deceased lady.

5. The charge sheet having been submitted under section 108 of the BNS shows that the allegation against him remains confined to abetment to suicide. However, no immediate and proximate cause has been shown as to why, the deceased would be led to commit suicide by the petitioner. The petitioner has clean antecedent and is in custody since 28.07.2024.

6. Considering the aforesaid facts and that charges have been framed and till date no witness has been examined, hence, the petitioner is enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 5th Additional Sessions Judge, Muzaffarpur in connection with Gaighat P.S.Case No.187 of 2024.
