This is an application for bail in connection with Bahadurpur P.S.Case No. 169 of 2017 registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.
Petitioner is named in the FIR and the case is under Section 302 IPC. As per FIR the petitioner has taken the deceased to a party and thereafter deceased has received injuries and the deceased was taken to hospital by the petitioner and later on he died because of injuries sustained by him.
Submission of learned counsel for the petitioner is that except suspicion there is nothing against him and moreover petitioner has taken the deceased to hospital for treatment and later on he has been made accused in this case and charge sheet has been submitted in this case and he is in custody since 18.7.2017 and charge sheet has been submitted.
Patna High Court Cr.Misc. No.45907 of 2017 (3) dt.11-10-2017 2/2 Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, this application is disposed of with a direction to learned court below that if the submissions of learned counsel are found to be correct, the petitioner shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Darbhanga, in connection with Bahadurpur P.S.case No. 169 of 2017, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court and (2) Petitioner shall co-operate in trial and appear on each and every date in court and on failure to appear in court in two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled.
