JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Sri Ajay Mukherjee, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 14.05.2017 in Suiya P.S. Case No.41 of 2017 registered for the offence under Section 30(a)/38 of the Bihar Prohibition and Excise Act, 2017 and Section 3 of Bihar Excise ( Mahua) Flower) Rule,2006, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that false recovery of about 2 quintals of Mahua flower was shown and the petitioner was arrested. By way of referring to the statement made in paragraph-3 of the petition, he submits that the petitioner is having clean antecedent.

Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner, namely,

Patna High Court Cr.Misc. No.39424 of 2017 (2) dt.19-08-2017 2/2 Kailash Pujahar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II, Banka in connection with Suiya P.S. Case No.41/17.
