Let the defect(s), if any, be removed within a period of four weeks from today.

This application for grant of regular bail arises out of Kaler Police Station Case No.117 of 2022 registered for the offence under Section 30(a), 42 of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that about 2376 liters of Indian made English wine has been recovered from a truck bearing Registration No.MH10AW8577. The petitioner has offered to pay Rs.40,000/- in the Ram Krishna Mission Ashram, R.K. Avenue, Nala Road, Patna without accepting his guilt.

Learned A.P.P. for the State has vehemently opposed the prayer for bail.

Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail after framing of charge and on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousands Only) with two sureties of the like amount each to the satisfaction of the learned Special Judge-II Excise, Jehanabad in connection with Kaler Police Station Case No.117 of 2022.

The petitioner shall deposit an amount of Rs.40,000/- (Rupees Forty Thousands Only), as has been offered by him, in the Ram Krishna Mission Ashram, R.K. Avenue, Nala Road, Patna and will produce the receipt of the same at the time of furnishing the bail bonds in the court below. The bail bonds of the petitioner shall be accepted only after he produces the receipt of Rs.40,000/- (Rupees Forty Thousands Only) issued by the Ram Krishna Mission Ashram, R.K. Avenue, Nala Road, Patna and after verifying the genuineness of the said receipt from concerned Ram Krishna Mission Ashram.
