Petitioner seeks bail in a case registered under Sections 302, 304B, 201, 120B/34 of Indian Penal Code. The petitioner is husband of the deceased and, therefore, liable for the prime responsibility of his wife. The allegation is that she has been done to death for non-fulfillment of demand of motorcycle and that the body has been disposed of. Learned counsel for the petitioner submits that in the investigation, one of the neighbours has deposed that she was suffering from small pox and she died as a result of her illness. No document on record shows that she was ever treated for the said illness.
Patna High Court Cr.Misc. No.12392 of 2018 (3) dt.05-04-2018 2/2 Considering the gravity of the offence and the fact that the petitioner is husband of victim, his prayer for bail is rejected.
