The petitioner apprehends his arrest in connection with Baikunthpur P.S. Case No. 246 of 2020 registered under Sections 30(a)/32 and 41 of Bihar Prohibition and Excise Act. Petitioner has earlier moved this Court for grant of bail in Cr. Misc. No. 4404 of 2021 which was rejected vide order dated 06.12.2021 (Annexure-1).

Submission of learned counsel for the petitioner is that petitioner had given his Bolero Pick-up Van to one Dilip Yadav for the fare of Rs. 500/- per day and driver has also given the undertaking that all the responsibility of the said vehicle will be upon him, as is evident from Annexure-3.

Learned A.P.P. appearing on behalf of the State opposed

Patna High Court CR. MISC. No.15024 of 2022(5) dt.27-04-2022 2/2 the prayer of the petitioner by contending that the document that has been given by the petitioner as contained in Annexure-3 is not a reliable document. Now, there is no fresh ground to consider the bail of the petitioner.

Having considered the facts and circumstances of the case and the submissions advanced on behalf of the opposite party, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is again rejected. (Arvind Srivastava, J) utkarsh/- U T
