JUSTICE MADHURESH PRASAD ORAL ORDER 05-04-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 304B, 201/34 IPC.

Learned counsel for the petitioner submits that the FIR has been lodged after delay as the alleged occurrence is of 21.4.2016 and the FIR lodged on 7.5.2016. In the FIR, it is alleged that the daughter of the informant was missing since 21.4.1996 and only after doubting the conduct of the petitioner who is husband of the victim, the FIR has been lodged which contains allegations with respect to demand of dowry. Petitioner is in custody since 29.11.2017.

Petitioner being husband of the victim has prime responsibility of the victim. Witnesses have also supported the allegation in respect of demand of dowry and the dead body of

Patna High Court Cr.Misc. No.12456 of 2018 (3) dt.05-04-2018 the victim has been done away with.

Considering the gravity of allegation, this Court for the present is not inclined to grant bail to the petitioner. The prayer for bail of the petitioner is rejected. (Madhuresh Prasad, J) Shashi.
