JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147/341/323/436/5047 of the Indian Penal Code.
Accusation is of putting the house of the informant on fire, as a result, the food-grains, ornaments and other household articles, kept in the house, were burnt to ashes. It is submitted by learned counsel for the petitioner that the petitioner is agnate of the informant and petitioner's side lodged Kateya P.S. Case No.237 of 2014 levelling accusation under sections 147,148, 149, 341, 323, 324, 307, 354, 436, 504 of the Indian Penal Code on 08.10.2014 and, thereafter, the present case has been lodged on 09.10.2014. The accusation is omnibus and general. A statement has been made in paragraph 3 of the
Patna High Court Cr.Misc. No.21270 of 2015 (2) dt.20-05-2015 2/2 petition that the petitioner has no criminal antecedent and, subsequently, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has been brought on record as annexure-4 to the petition.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gopalganj in connection with Kateya P.S. Case No.238 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
