JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 07-03-2019 This appeal is for grant of pre-arrest bail to the appellants against the order dated 1.2.2019 passed by Special Judge, SC/ST Act, Patna, in A.B.P. No.311 of 2019 by which learned Special Judge has rejected prayer for prearrest bail of the appellants, who have been made accused in Special Case No. 406 of 2018, arising out of Maner P.S.Case No. 389 of 2018, registered under Sections 341, 323, 379, 504, 34 of the Indian Penal Code and Section 3(i)(r) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Allegation against the appellants is that they came along with others and abused the informant by caste name and thereafter other accused persons came with rod and assaulted the informant and his son. Submission of learned counsel for the appellants is that there is general and omnibus allegation against them and they have falsely been implicated in this case.
