Having regard to the nature of allegation for offence under sections 420, 409, 467, 468, 471, 120B of the Indian Penal Code against the petitioner, the President of the Education Committee, who is said to have misappropriated the Government money to the tune of Rs.7.12,000/- alongwith Pramod Kumasr Singh, the Headmaster as also the Secretary of the Committee, namely, Smt. Manju Devi and Makaindey Kumar, another member of the Committee, this Court in order to maintain parity would be inclined to grant privilege of anticipatory bail to the petitioner, the President of the Education Committee only if he also alike the Headmaster pays a sum of Rs.1,69,000/- in the name of the Collector of Siwan District by a Bank draft and produces a receipt of the same at the time of surrender within a period of six weeks

Subject to fulfillment of the aforementioned condition, the petitioner, Hareram Singh, shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Ziradei P.S.Case No. 05/2015, on the following conditions:

(i) The aforementioned amount of Rs.1,69,000/- deposited by the petitioner through the Bank draft in the name of the Collector of Siwan District shall remain subject to final result of the pending trial.

(ii) That both the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how they are related with the petitioner. The bailors will also undertake to inform the Court if there is any change in the address of the petitioner.

(iii) That the bailor shall also state on affidavit that he will inform the Court concerned if the petitioner is implicated in any other case of similar nature after his release in the present case and thereafter the Court below will be at liberty to initiate the proceeding for cancellation of bail on the ground of misuse.

Patna High Court Cr.Misc. No.18753 of 2015 (2) dt.17-06-2015 (iv) That the petitioner will be well represented on each and every date of trial and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled on this ground alone.
