The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 354B, 506/34 of the Indian Penal Code and 3⁄4 of the Prevention of Witch Practices Act.
It is alleged that informant gave jewellary of Rs. 11,20,000/- and cash Rs. 03,41,000/- to Binod Ram and Dinanath Rai for curing her daughter, who was under the influenced of witch craft. It is further alleged that petitioner also conspired as neither the daughter of the informant was cured nor the entire money was returned. It is submitted by the learned counsel for the petitioner that the thrust of accusation is against Binod Ram (non-petitioner) and Dinanath Rai (non-petitioner). Statement
Patna High Court Cr.Misc. No.9547 of 2015 (2) dt.21-04-2015 has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (M) P.S. Case No. 324 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
