The petitioner apprehends his arrest in Pipra P.S. case No. 241 of 2017 for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant alleged that her husband and fatherin-law brought her from her father's house but after some days her husband started strangulating her with a view to kill her. The informant had earlier lodged a case under Section 498A of the IPC which is pending in the court of Judicial Magistrate. The learned counsel for the petitioner submits that petitioner is father-in-law of the informant. The informant did not get any injury. There is no allegation of assault or even touching
Patna High Court Cr.Misc. No.17476 of 2018 (2) dt.05-04-2018 2/2 the body of informant against the petitioner. The petitioner has no manner of concern with the informant and her husband. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is father-in-law of the informant, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Pipra P.S. case No. 241 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
