JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Kashichak P.S. Case No. 113 of 2021, registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and section 66(C), 66(D) of the Information Technology Act. On secret information that some persons were committing forgery and cheating at ABF brick-kiln by giving temptation to innocent person through mobile, a raid was conducted. After seeing the police personnel some persons started fleeing away and one person was arrested who disclosed his name as Santu Kumar and mobile phone besides other articles were recovered from his possession. The apprehended person disclosed the name of four persons including this

It is submitted that no incriminating article has been recovered from possession of this petitioner. Save and except confessional statement of co-accused there is material which show his complicity in the alleged occurrence. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Nawada in connection with Kashichak (Sahpur OP) P.S. Case No. 113 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) BKS/- U T
