JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks bail in connection with Jalalpur P.S. Case No. 75 of 2017 registered for offences punishable under sections 272 and 273 of the Indian Penal Code and Section 30(A) Excise Act.
Allegation against the petitioner is that 99 litres of foreign liquor was recovered from the vehicle in which he was traveling.
Learned counsel for the petitioner submitted that he has clean antecedent and has falsely been implicated in this case. It has been further submitted that other accused having similar allegation has been granted bail by a co-ordinate Bench of this Court vide Annexure-2 passed in Criminal Misc. No. 29111 of 2017 vide order dated 03.07.2017. The petitioner has been in
custody for about two months.
Heard learned A.P.P. has also opposed the prayer for bail.
Having heard both sides and considering the aforementioned facts and circumstances, let petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran, in connection with Jalalpur P.S. Case No. 75 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not adduce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the Court and on the event of failure on his part to appear before the Court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
