The petitioner seeks bail in Chautarwa P.S. Case No. 27 of 2018 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

27.465 litres of foreign liquor is said to have been recovered from the car which met accident with the Safari vehicle and two persons including the petitioner were found sitting in the said car in injured condition.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern

Patna High Court Cr.Misc. No.21964 of 2018 (2) dt.17-04-2018 2/2 with the seized liquor. As a matter of fact, the driver of the said car fled away after the accident and the petitioner who was travelling by the said car as simple commuter was apprehended as he was injured in the accident. The petitioner had no knowledge of keeping of the aforesaid liquor in the said vehicle. He has no criminal antecedent and has been languishing in custody since 01.03.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bettiah, West Champaran in connection with Chautarwa P.S. Case No. 27 of 2018.
