JUSTICE ARUN KUMAR ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in N.H. Bangra P.S. Case No.39 of 2016 registered under Sections 341, 326, 307, 498(A), 302 and 504 of the Indian Penal Code. Allegation in brief is that the petitioner poured kerosene oil over the body of the informant his wife and set fire as a result he succumbed to the burn injury.
Learned counsel appearing on behalf of the petitioner submits that in fact the victim died due to accidental burn injury and she was being taken to P.M.C.H., Patna but on the way she died and the statement of the informant is in fact is not her statement rather after death her L.T.I. was put on statement. Having considered the nature of allegation that too
Patna High Court Cr.Misc. No.28303 of 2017 (3) dt.20-07-2017 2/2 specific allegation against this petitioner, so prayer for regular bail of the petitioner, namely, Md. Rizwan in connection with N.H. Bangra P.S. Case No.39 of 2016 (G.R. No.1386/16, S.T. No.182/2017) pending in the court of Sessions Judge, Samastipur is rejected. The trial court is directed to expedite the trial. Let a copy of this order be sent to the S.P., Samastipur to produce the witnesses regularly for examination before the court.
