This is an application for bail in connection with Morkahi P.S. Case No. 105 of 2016, registered for the offences punishable under Sections 386/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is of demand of extortion of Rs.10,000/-.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and one day earlier a case has been lodged by the petitioner against informant and for that he has filed the false case. Further submission is that he is in custody since 24.7.2017 and co-accused has been granted bail by a coordinate Bench of this Court in Cr.Misc.No. 11054 of 2017, vide order dated 18.3.2017 (Annexure-2).

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria, in connection with Morkahi P.S.Case No. 105 of 2016, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
