Petitioner, already in custody, seeks bail in connection with Ram Krishna Nagar P.S. Case No.44 of 2018, registered under Section 376 of the Indian Penal Code as well as under Sections 4, 6, 8 of the POCSO Act.

Allegation in brief is that the prosecutrix was being raped by her own grandfather and she brought this fact to the knowledge of her mother, the petitioner, but she did not take any step to protect her daughter.

Learned counsel for the petitioner submits that only allegation against the petitioner is that being mother, she did not take any step to protect her daughter from the grandfather and the allegation of rape is against Ram Sagar Prasad, the

Having considered the aforesaid facts and circumstances, petitioner Kiran Devi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge-I-cum-Special Judge, POCSO, Patna in connection with Ram Krishna Nagar P.S. Case No.44 of 2018.
