====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner is in custody since 16.12.2019 and seeks bail in connection with Bhagwan Bazar P. S. Case No.26 of 2019 registered for the offences punishable under Section 304(B)/ 34 of the I.P.C.

Petitioner happens to be husband of the deceased, but in the written report of the informant, it has been mentioned that on the alleged date of occurrence, petitioner was not present at his home rather he had gone abroad.

No doubt, deceased died in other than normal circumstances, within one year of marriage, but taking note of

No.20771 of 2020(4) dt.02-12-2020 2/2 the above stated facts and also keeping in mind that petitioner is in jail custody for near-about one year, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra at Saran in connection with Bhagwan Bazar P. S. Case No.26 of 2019.
