The petitioner has been in custody since 16.04.2018 in connection with Simri P.S. Case No. 46 of 2018 registered for the offense punishable under Sections 364 of the Indian Penal Code.

The present petitioner seeks to renew his prayer for bail which was earlier rejected vide order dated 16.07.2018 passed in Cr. Misc. No. 34663 of 2018.

Learned counsel for the petitioner submits that though this petitioner has been in custody for one year, he is willing to co-operate in the trial and shall appear in Court as and when required. So far as the criminal antecedent of the petitioner is concerned, he has a clean past and since the trial of the case has

Patna High Court CR. MISC. No.19937 of 2019(2) dt.17-04-2019 2/2 not yet progressed, the petitioner may be extended the privilege of bail. It is further submitted that the other co-accused person has also been granted bail vide order passed in Cr. Misc. No. 74097 of 2018 on 25.01.2019 by this Court in the case of Md. Dilshad.

Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Simri P.S. Case No. 46 of 2018.
