JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being sister of the husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 498A and 420 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Basic accusation is of torture for non-fulfillment of dowry demand. It is specifically alleged against the petitioner that she supported the demand of car as dowry and assaulted the complainant by pulling her hair.

It is submitted by learned counsel for the petitioner that omnibus and general accusation has been levelled against the entire in-laws family including the petitioner. There is nothing on

Moreover, at earlier point of time, the husband of the complainant filed Matrimonial Case No.147/2015 with a prayer for divorce and, thereafter, the present case has been filed. Considering the thrust of accusation against the husband of the complainant and the petitioner being lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Complaint Case No.854 C of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
