Petitioner, already in custody, seeks bail in connection with Jhajha P.S. Case No.200 of 2017, registered under Sections 399 and 402 of the Indian Penal Code as well as under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Allegation in brief is that one country made pistol and two live cartridges were recovered from possession of the petitioner and arms were recovered from other accused persons also.

Learned counsel for the petitioner submits that another co-accused, Ravi Yadav has been admitted to bail by a coordinate Bench of this Court vide Cr. Misc. No.53324 of 2017 on 17.11.2017 from whom recovery of country made pistol and

Patna High Court Cr.Misc. No.22711 of 2018(2) dt.17-04-2018 2/2 cartridges were recovered, this petitioner is in custody for about nine months and the petitioner has only one criminal antecedent under Section 366A of the Indian Penal Code.

Having considered the aforesaid facts and circumstances, petitioner Pankaj Kumar @ Pankaj Ram is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in connection with Jhajha P.S. Case No.200 of 2017, giving rise to Sessions Trial No.31 of 2018.
