The petitioner is accused in connection with G.O. Case No. 01 of 2018 arising out of Sadar P.S. Case No. 502 of 2017, registered under Sections 272, 273, 420, 327 and 162/34 of the Indian Penal Code and Sections 27(d), 28, 28(A) and 22(b) of the Narcotics Drugs and Psychotropic Substances Act and Section 8/9 of the Prevention of Corruption Act 1988 and Section 30/36/38/47 of the Bihar Excise Act, 2016.

The accusation is that in course of checking of the vehicle, one Innova Car was searched, from which, 2000 bottles each containing 100 ML corex syrup recovered and in the said

Patna High Court Cr.Misc. No.17435 of 2018 (2) dt.28-03-2018 vehicle two persons were found sitting, who disclosed their names as Gopal Kumar Jha and Md. Ashfaque Alam. On enquiry, both persons disclosed that car belongs to Saurav Kumar Roy and also disclosed that Shyamdeo Roy, Md. Manauwar (petitioner) and Saurav Kumar Roy, who indulged in the smuggling of cough syrup, and they are present at some distance. Thereafter, informant reached there then Saurav Kumar offered Rs.70000/- to settle the matter and to help in illegal transaction of cough syrup bottles. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 30.12.2017. It is further submitted that the charge sheet has already been submitted against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional Sessions Judge, Darbhanga, in connection with G.O. Case No. 01 of 2018 arising out of Sadar P.S. Case No. 502 of 2017. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
