The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 307, 506 of the Indian Penal Code and 27, 25(1-B)a and 26 of the Arms Act. Allegation against the accused persons is that when he informant along with his uncle was on the way, he accused persons variously armed shot fire due to which the informant received injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.11.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case A

Patna High Court CR. MISC. No.14784 of 2019(3) dt.11-04-2019 2/2 single blow is alleged to have been made by the petitioner. The injury caused by the petitioner has not been indicated to be simple or grievous. It is further submitted that the petitioner may be released after completion of one year in custody. On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case. Considering the aforesaid facts and circumstances, it is directed that after completion of one year in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Railway at Ara in connection with Ara Rail P.S. Case No. 67 of 2018.
