2. The petitioners apprehend their arrest in connection with Shikarpur P.S. Case No. 933 of 2024 instituted for the offences punishable under Sections 126(2) 115(2), 109, 76, 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'B.N.S.').

3. As per the prosecution case, in the Fardbeyan of the informant Manoj Kumar Sahani recorded by ASI Ram Kumar Paswan alleging therein that on 28.11.2024 at around 7:00 P.M. his brother's wife started abusing his wife Rupa Devi and his

Patna High Court CR. MISC. No.13967 of 2025(2) dt.28-03-2025 2/3 sister-in-law Anju Devi and when his sister-in-law objected, the FIR named five accused persons started abusing and assaulting his wife and sister-in-law with lathi and fatha.

4. Learned counsel for the petitioners submits that petitioners are innocent have committed no offence and have falsely been implicated in this case due to family dispute. He further submits that petitioners are the ladies members of the cosharer of the informant. He next submits that both the parties are own family members and there is land dispute attributed between the parties. He lastly submits that petitioners have got clean antecedent as stated in para 3 of the petition.

5. Learned APP opposes the prayer for bail.

From perusal of the FIR and the impugned order of the learned Sessions Judge, West Champaran at Bettiah dated 04.02.2025, it appears that all the three petitioners are ladies and the allegation against petitioner nos. 1 and 2 are that she caught informant's wife hair and dragged her on the ground and the allegation against petitioner no. 3 is that she took away the gold chain from Anju Devi's neck. Petitioners are ladies members of the co-sharer of the informant and there is land dispute attributed between the parties, so considering all these aspects let these petitioners above named in the event of their arrest or

No.13967 of 2025(2) dt.28-03-2025 3/3 surrender before the Court below within six weeks from today, be released on bail upon furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 933 of 2024, subject to the conditions laid down in Section 482(2) of the B.N.N.S.
