2. The petitioner is apprehending his arrest in connection with Laxmipur P.S. Case No. 290 of 2024, F.I.R. dated 30.08.2024 for the offences punishable under Sections 319(2), 318(4), 105, 352, 351(2), 61 of Bharatiya Nyay Sanhita.
3. According to prosecution case, informant alleged that due to negligence of the petitioner in giving treatment, his daughter died.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the
Patna High Court CR. MISC. No.15213 of 2025(3) dt.07-05-2025 2/2 F.I.R.
5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that as per paragraph-58 of the case diary it appears that the owner of the hospital in question is Dr. Shobha Kant Pandey but the petitioner and other co-accused, namely, Manita Devi is running the present hospital in question and apart from that it has also come in the report of Dy. S.P that the petitioner was also involved in the present crime in question.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioners in connection with Laxmipur P.S. Case No. 290 of 2024 pending in the court of Chief Judicial Magistrate, Jamui
7. Prayer is refused.
