JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-09-2017 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Buxar (T) P.S. Case No. 119 of 2017 for the offences punishable under Section 379 of the Indian Penal Code.

According to the prosecution case, the informant filed a written petition before S.H.O. of Buxar (Town) police station on 17.03.2017 alleging that he had parked his Hero Honda Motorcycle near the main Gate of the Buxar court and went to the court and when he returned back, he saw that his motorcycle has been stolen. Subsequently, it appears that several motorcycles were recovered in Balia and three cases were filed at Balia and two cases were filed at Buxar. The petitioner and others are said to

The learned counsel for the petitioner submits that as far as the petitioner is concerned, the motorcycles have not been recovered either from his possession or from his house and he has a clean antecedent. It is further submitted that only after he was arrested in Buxar P.S. Case No. 119 of 2017 and Buxar P.S. Case No. 120 of 2017, he has been made an accused in Balia (Kotwali) P.S. Case No.551 of 2017, 545 of 2017 and 562 of 2017 which are also for the same occurrence and the same incident. It is also submitted that the petitioner has already been granted bail in Buxar (T) P.S. Case No. 120 of 2017 and as far as Buxar (T) P.S. Case No. 119 of 2017 is concerned, the other co-accused persons have been granted bail.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case No. 119 of 2017.
