2. The petitioner is in custody in connection with Didarganj P.S Case No. 21 of 2024 registered for the offences punishable under Sections 302, 34 of the I.P.C
3. As per prosecution case, petitioner along with his family members have assaulted the informant and his family members, due to which, son of the informant died during course of the treatment.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that petitioner has got clean antecedent. It is also submitted that petitioner is in judicial custody since 24.06.2024.
Patna High Court CR. MISC. No.14744 of 2025(3) dt.14-05-2025 2/2 It is further submitted that occurrence is of 09.12.2023 and FIR lodged on 21.01.2024 and there is delay of more than one months in lodging the FIR.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR and impugned order, it appears that specific allegation against other accused person to assaulted the son of the informant by iron rod and there is no allegation of any overt act against the petitioner. Petitioner is in custody since 24.06.2024 and he has got no criminal antecedent as stated in paragraph 3 of the bail petition.
7. Considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Patna City, Patna in connection with Didarganj P.S Case No. 21 of 2024.
