The petitioner seeks regular bail in Sikandara P.S. Case No. 94 of 2017 registered for the offence under Sections 414, 467, 468, 471, 484/34 of the I.P.C.

Allegation against the petitioner is of recovery of motor cycle from his possession and he failed to show relevant papers with respect to the aforesaid motor cycle. He is accused in one more case under Section 379 of I.P.C.

Submission of the learned counsel for the petitioner is that the police made search at different places and recovered several motor cycles and he has been falsely implicated in this case. He is in custody since 8.7.2017 and after his arrest he has been made accused in the case under Section 379 of I.P.C.

Having heard both sides and in view of the facts and circumstances of the case, as stated above, at this stage I am not inclined to grant bail to the petitioner. However, this application is disposed of with direction that if the petitioner remains in custody for five months or once charge is framed against the petitioner whichever is earlier, the trial court will release the petitioner on bail to his own satisfaction.
