JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-05-2015 This application under section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 25.03.2015 passed in Cr. Misc. No.15 of 2015, whereby the learned Sessions Judge, Lakhisarai has dismissed the application for modification in the order dated 22.09.2014 passed in A.B.P. No.58 of 2014.

Regard being had to the submission made by the learned counsel for the petitioner, the impugned order dated 25.03.2015 passed by the learned Sessions Judge, Lakhisarai in Cr. Misc. No. 15 of 2015 is set aside subject to the condition that the petitioner

Patna High Court Cr.Misc. No.18785 of 2015 (2) dt.05-05-2015 2/2 would surrender within three weeks from today before the learned Sub Divisional Judicial Magistrate, Lakhisarai in connection with Piri Bazar P.S. Case No.19 of 2013. In case the petitioner surrenders within the stipulated period of three weeks, he shall be released in terms of the order dated 22.09.2014 passed by the learned Sessions Judge, Lakhisarai in A.B.P. No. 58 of 2014. In case he fails to appear within the stipulated period, the present order would be deemed to be recalled.
