The petitioner apprehends his arrest in Vidyapati Nagar P.S. Case No. 87 of 2021, registered for the offences punishable under Section 379, 323 and other allied sections of the Indian Penal Code.

As per the prosecution case while the informant was standing at his door, all the named accused persons including petitioner abused the informant. On protest, this petitioner assaulted him with Khanti on his head due to which he fell down. It is further alleged that other family members of informant who came to save him they were also assaulted by the co-accused persons.

Patna High Court CR. MISC. No.14942 of 2022(2) dt.23-08-2022 2/2 took place between the parties. Both sides sustained injuries. Case lodged by the petitioner's side is earlier in point of time. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate -3, Dalsinghsarai, Samastipur in connection with Vidyapati Nagar P.S. Case No. 87 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
