The petitioner is apprehending his arrest in connection with Nawada (Town) Police Station Case No.515 of 2014 for allegedly having committed the offence under Sections 420/467/468/471/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner and the informant are both agnates and have held properties jointly. This is evident from perusal of Annexure-2 itself. Learned counsel further submits that if at all there was a dispute regarding the title and shares, it ought to have been resolved in civil dispute before the appropriate authorities. Considering the aforementioned submissions and the nature of relationship between the parties, it is evident that there

No.20298 of 2015 (2) dt.23-07-2015 2/2 is some family dispute with regard to the ownership and possession of the land, in question, which could be well resolved in a Court of appropriate jurisdiction, and also the fact that the petitioner has no criminal antecedents is, thus, fairly entitled to be extended the benefit of anticipatory bail, let the above-named petitioner, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada (Town) Police Station Case No.515 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
