2. In the instant petition, petitioner has prayed for the following relief/reliefs:

"That petitioner craves indulgence of this Hon'ble Court for issuance of an appropriate writ commanding the respondents directing him to issue range order (Kshetradesh) pursuant the memo No. 34 dated 15.1.2021 (Annexure 2) issued under the signature of respondent No. 4 were by and where under petitioner has been granted 2nd ACP from the date of its due i.e. 20.06.2011 and further direction to the respondents to make pay fixation of the petitioner on the basis of 2nd ACP as also for direction to calculate the arrears and make payment to the same to him alongwith interest on market rate as petitioner has been deprived from the same without any fault attributable him."

3. Short question for consideration is whether petitioner is entitled to monetary benefits on account of grant of A.C.P. from 20th June, 2011 pursuant to the Memo No. 34 dated 15.01.2021 or not? In this regard, the petitioner submitted three representations on 03.02.2021, 11.02.2021 and 19.02.2021. He has also pointed out letter No. 436 dated 14.02.2021. In the light of these facts and circumstances, the concerned respondent is hereby directed to extend monetary benefits (dues of amount) on account of extending 2nd A.C.P. to the petitioner along with interest @ of 6 % per annum three years prior to filing of the present petition till payment is made. The dues of amount and interest shall be calculated and disbursed.

If the petitioner is otherwise not eligible for monetary benefits, in that event, necessary speaking order shall be passed and communicated to the petitioner. The above exercise shall be completed within a period of one month from the date of receipt of this order, failing which, petitioner is entitled to litigation cost and it is quantified @ of Rs. 10,000/- With the above observations, writ petition stands disposed off.
