The petitioner apprehends his arrest in Nabinagar P.S. Case No. 125 of 2015, registered for the offences punishable under Sections 304(B) and 34 of the Indian Penal Code. The petitioner is brother-in-law of the deceased. The deceased was married with Mahendra Kumar Singh the elder brother of the petitioner four years ago. It is alleged that all inlaws of the deceased including the petitioner tortured the deceased in connection with demand of additional dowry. It is submitted that the petitioner has no manner of concern with the deceased and her family affairs. Mother-in-law of the deceased Lilawati Devi has already been enlarged on anticipatory bail in Cr. Misc. No., 7583 of 2016 on 17.03.2016 by
Patna High Court Cr.Misc. No.15441 of 2016 (2) dt.03-05-2016 2/2 a coordinate Bench of this Court. It is further submitted that the father of the deceased has already been granted regular bail. Considering the facts aforesaid and the fact that the petitioner who is brother-in-law of the deceased, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Aurangabad in Nabinagar P.S. Case No. 125 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
