JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections395 and 412 of the Indian Penal Code. As per prosecution case, gold ornaments weighing 45 grams, cash of Rs. 8700/-, old ornament of silver, two mobiles as well as ATM card of the informant were looted by unknown miscreants on the point of pistol.
It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR. Nothing incriminating article has been recovered from the possession of the petitioner. There is nothing on the record indicating complicity of the petitioner in the occurrence barring confessional statement of coaccused persons. The petitioner is in custody since 01.04.2017.
