The contempt application has been initiated on the basis of the letter dated 12.9.1993 received from the petitioner. Since the petitioner did not appear at any stage of the court proceedings the matter was directed to be looked into by the respondents in the writ petition, if any representation was filed by the petitioner, as the petitioner was being not paid his retiral dues after 20 years of his retirement.

On our direction, a show cause has been filed on behalf of the opposite party Engineer-in-Chief, RCD, Bihar, Patna in which it is stated that since no details even of the post of the petitioner have been obtained from the records they have made an enquiry to obtain details regarding the petitioner and the local official of the department has been informed by the son of the petitioner that his father was an employee of the department and

Patna High Court MJC No.1079 of 1993 (5) dt.20-04-2015 died in the year 2002 and his mother (wife of the petitioner) also expired six years back.

On a consideration of the aforesaid facts, there does not appear to be any purpose in proceeding further with the contempt application. It is, accordingly, disposed of. (Ramesh Kumar Datta, J) (Anjana Mishra, J) spal/- U
