JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-07-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Shekhopur Sarai P.S. Case no. 35 of 2019, registered under Sections 147, 148, 149, 341, 323 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in the evening of 01.05.2019, informant Uday Yadav along with his son Shyam Sundar Kumar proceeded from house to Dalan, when they reached near Dalan of Kameshwar Yadav then some persons caught hold of his son Shyam Sundar Kumar and fired, which hit at his chest. The assailants were Rambir Yadav, Ranjeet Yadav, Guddu Yadav, Lallu Yadav, Yadu Yadav and Ramnandan Yadav, at that time, Rambir Yadav had pistol in his

Patna High Court CR. MISC. No.12765 of 2020(2) dt.01-07-2020 2/2 hand and he fired at his son, while Ranjit Yadav (Petitioner) caught hold his son. The cause of occurrence is that in the Gotiya of petitioner a murder took place in which Bharat Kumar, elder son of informant, was one of the accused due to that reason the occurrence took place in revenge of that murder. Learned counsel for the petitioner submits that, in fact, firing was made by co-accused Rambir Yadav, but the petitioner and others have falsely been implicated in this case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Sheikhpura in connection with Shekhopur Sarai P.S. Case No. 35 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
