Heard the parties.
This application, for grant of anticipatory bail, arises out of Ballia P.S. Case No.294 of 2015, disclosing offences under Sections 341, 323, 325 and 302/34 of the
Patna High Court Cr.Misc. No.14208 of 2016 (5) dt.22-06-2016 2/3 Indian Penal Code.
From the First Information Report, it appears that when the children of the two families were playing, a quarrel took place between them, whereafter, an altercation and consequent occurrence took place. From the First Information Report, I find that there is specific allegation of assault against petitioner No.1, who is a lady.
Learned counsel, appearing on behalf of petitioner No.1, has submitted that being a lady, there is no chance of the petitioner absconding from the course of trial or investigation.
Considering the submission, as above, this application is allowed. Let petitioner No.1, abovenamed, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No.294 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that petitioner No.1 shall present herself before the police/Court, as the
Patna High Court Cr.Misc. No.14208 of 2016 (5) dt.22-06-2016 3/3 case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bond shall be liable to be cancelled.
