This application is for grant of regular bail in connection with Bakhari (Parihara) P.S.Case no.260 of 2016 for the offences punishable under Sections 420, 406 and 34 of the Indian Penal Code.
Allegation against the petitioner is that he has taken Rs.7,73,000/- from the informant on the assurance that he will get the daughter of the informant married but now the amount is not being returned.
Submission of the learned counsel for the petitioner is that no such amount has been paid to the petitioner and in support of that he has shown the pass book and no any amount has been deposited in the account.
Patna High Court Cr.Misc. No.41305 of 2017 (4) dt.06-11-2017 2/2 Heard learned A.P.P. and the learned counsel for the informant. The learned counsel for the informant has filed supplementary affidavit and Annexures 'A' to 'C' show that the petitioner and the father of the petitioner have admitted in the court below of taking money.
Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial and try to conduct it on day-to-day basis so as to it may be concluded within a period of four months, and if not concluded, the learned court below shall release the petitioner in connection with Bakhari (Parihara) P.S.Case NO.260 of 2016 to his own satisfaction.
With the aforesaid observation, this application is disposed of.
