JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-11-2017 The petitioner seeks regular bail in connection with Jamui P.S. Case No. 237 of 2016, registered for offences punishable under Sections 341, 323, 324, 307 and 504 of Indian Penal Code.

Allegation against the petitioner is of assault to the informant by means of Dabiya on his neck.

It has been submitted on behalf of the petitioner that there was no intention to kill the informant, which will appear from the fact that there is no repetition of blow. Further petitioner has been in custody since 25.08.2016 and uptil now only charge has been framed and no witness has been examined.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and

No.48629 of 2017 (5) dt.21-11-2017 circumstances of the case and also the fact that the injuries caused to the informant was found to be grievous and that too on the vital part of his body, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected. However, since the petitioner has been in custody for last 15 months and now charge has also been framed, the trial court is directed to expedite the trial and try to conclude it within a period of seven months, even by conducting it on day to day basis. At the same time, S.P. Jamui, is also directed to ensure production of witnesses in the Trial Court on the date fixed so that the trial can be concluded within the aforesaid period.
