The sole petitioner, apprehending his arrest in connection with Buxar (T) P.S. Case No.77 of 2015 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code has prayed for grant of anticipatory bail. Learned counsel for the petitioner submits that ofcourse in the F.I.R. it was alleged that petitioner at the time of occurrence was carrying a Garasa, but there is no allegation of giving assault. However, allegation of giving assault was made against Vivek Dubey.

I have perused the F.I.R. and the materials available on record.

I do not find any ground to extend the privilege of

Patna High Court Cr.Misc. No.19211 of 2015 (2) dt.15-06-2015 2/2 anticipatory bail.

The petition stands dismissed.
