2. The petitioner is apprehending arrest in connection with Nabinagar P.S. Case No. 206 of 2022, registered on 21.06.2022, for the offences punishable under Section 30(a) Bihar Prohibition and Excise (Amendment) Act, 2018.

3. As per the prosecution, total 2.07 litres of illicit liquor has been recovered from the tempo, which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the said tempo was sold by the petitioner on 18.12.2021. The petitioner had no connection with the said tempo, however, due to the failure to transfer the ownership, the

5. Learned APP for the State opposes the prayer for bail.

6. In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of District and Additional Sessions Judge- cum- Special Judge, Excise Court No. 1, Aurangabad (Bihar), in connection with Nabinagar P.S. Case No. 206 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
