Petitioners are apprehending their arrest in connection with Gr. No.2939 of 2017 arising out of Kawakole P.S.Case No.176 of 2017 , registered for offences punishable under Sections 147, 149, 341, 323, 324, 307 of the Indian Penal Code. As per the FIR the petitioners and other accused persons assaulted the informant and others while they were going to see Durga Puja Mela.

Submission of the learned counsel for the petitioners is that there is general and omnibus allegation against all the petitioners and there is case and counter case and one person

Patna High Court CR. MISC. No.15631 of 2019(4) dt.24-09-2019 2/2 has badly been assaulted by the informant and others and considering the above fact the other co-accused persons have been granted privilege of anticipatory bail, vide order dated 21.6.2019 passed in Cr. Misc. No.16617 of 2019 . Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM IV, Nawada in connection with Gr. No.2939 of 2017 arising out of Kawakole P.S.Case No.176 of 2017, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
