NILU AGRAWAL ORAL ORDER 08-03-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the State. Petitioner is languishing in judicial custody since 27.10.2018 as stated in para-9 of the present application in connection with Nawada (Nagar) P.S.Case No.792 of 2018 for the offence alleged under Sections 399, 402 and 411 of the Indian Penal Code and Sections 25(1-b)a and 26 of the Arms Act.

The prosecution case as lodged by the police personnel is that on secret information that some criminals have assembled to commit crime, the police conducted a raid and apprehended four persons including the petitioner. From the petitioner, one country made loaded pistol was recovered and from the possession of other co-accused also arms and ammunitions were recovered. Accordingly, a seizure list was

It has been submitted by the learned counsel for the petitioner that he is innocent, bear no criminal antecedent and has been falsely implicated only on the highhandedness of the police. He submits that chargesheet has already been submitted, there being no allegation of tampering with the prosecution evidence and the petitioner is languishing in judicial custody since more than four months. He further submits that on similar allegation one of the co-accused apprehended along with the petitioner has since been granted the privilege of bail by a coordinate Bench of this Court in Cr.Misc.No.2748 of 2019 dated 22.01.2019.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances, the period of custody and that chargesheet has already been submitted, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nawada (Nagar) P.S.Case No.792 of 2018 to the satisfaction of learned Chief Judicial Magistrate, Nawada, subject to the conditions that one of the bailors would be a close relative of the petitioner having
