This application is for grant of regular bail in connection with Mahila P.S.Case No.76 of 2017, for the offences punishable under Sections 498(A), 307, 341/34 of the Indian Penal Code and Section 3/4 of D.P.Act.
Allegation against the petitioners is that they set their daughter-in-law on fire causing her death.
Submission of the learned counsel for the petitioners is that the death of the deceased is due to burn injuries in this case and the witnesses have also stated so, as such, they have been falsely implicated in this case. As a matter of fact there is dispute between the petitioner no.1 & 2 with their son so he has falsely
Patna High Court Cr.Misc. No.33773 of 2017 (3) dt.31-07-2017 2/2 implicated them in this case. Now they are in custody for about three months.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioners, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months and if not concluded, the petitioner is at liberty to renew his prayer for bail bond before the court concerned. With the aforesaid observation, this application is dismissed.
