2. The petitioners have sought a direction to the respondents, particularly respondent no. 4, to consider their cases for appointment on Class-IV post from the Group-D panel which was prepared pursuant to an Advertisement No. 3/10 dated 03.06.2010.

It is the case of the petitioners that along with the daily wage employees, the petitioners also were empaneled but only in the 4th list which contained the names of fresh candidates desirous of being appointed on Class-IV post. It is the further case of the petitioners that some of the persons from the said panel have been appointed. There are number of vacant posts available but respondent no. 4 has shown complete apathy to filling up such posts from the list of empaneled candidates including the petitioners.

Under the aforesaid circumstances, this Court deems it appropriate to direct the petitioners to make a fresh representation before the District Magistrate, Patna (respondent no. 4) within a period of four weeks from today, ventilating their grievances and indicating the vacancy position along with a request for appointing them on such vacant post. Should such a representation be filed within the aforesaid period by the petitioners, the same shall be looked into by the respondent no. 4 and a

Patna High Court CWJC No.8226 of 2019 dt.19-06-2019 3/3 reasoned order shall be passed within a further period of six weeks thereafter.

5. With the aforesaid direction/observation, the writ petition stands disposed of.
