The petitioner is languishing in custody for the offences punishable under Sections 30(a)/41(i) of the Bihar Prohibition and Excise Act, 2016.

Recovery of liquor is not alleged from the possession of the petitioner or from the house of the petitioner. However, the petitioner has got identical criminal antecedents. The petitioner is in custody since 29.01.2019.

Considering the entire facts, let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the

Patna High Court CR. MISC. No.17068 of 2019(2) dt.10-04-2019 2/2 learned Court-below where the case is pending in connection with G.O. Case No.758 of 2018, arising out of Bahadurpur P.S. Case No.383 of 2018, with condition that petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
