JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 341, 323, 325 and 504/34 of the Indian Penal Code and Section 3(i) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Allegation against the petitioners is that they assaulted informant and his family members by lathi and danda and also abused them by taking their caste name.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. They have falsely been implicated in the present case. The occurrence is said to have taken place due to very petty reason. No offence is made out under SC & ST Act as the alleged occurrence is said to have taken place inside the house. On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each

Patna High Court Cr.Misc.
