JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,467 and 468 of the Indian Penal Code.

It is alleged that the petitioner took benefits under the BPL scheme from Minga Panchayat as well as from Begumpur Panchayat under Naokothi block.

It is submitted by the learned counsel for the petitioner that the petitioner's husband was resident of Begumpur village under Naokothi block but she never took any benefit under the BPL scheme from Minga Panchayat. It is further submitted that the son of the petitioner was elected as Ward Member of the Panchayat where the complainant is Mukhia, hence due to political rivalry the accusation has been

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Barauni P.S. Case No. 141 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bond of the petitioner shall be accepted provisionally till it is verified that the petitioner has not taken benefits under BPL scheme from two panchayats. (Dinesh Kumar Singh, J) Anil/- U T
